Picky Picky Pickleball - Terms of Use

Picky Picky Limited 於香港營運 Picky Picky Pickleball 品牌總部、多品牌裝備展示體驗中心（Showroom）及產品測試基地。凡預約設施體驗、進入本場所、辦理 E-Shop 訂單自提或參與任何專屬訓練活動，即表示您確認已閱讀、理解並同意以下條款。如您不同意本條款，請勿使用本場所。 如中英文版本有任何歧義、差異或不一致之處，概以英文版本為準。

Picky Picky Limited operates the Picky Picky Pickleball Brand Headquarters, Multi-Brand Showroom, and Product Testing Facility in Hong Kong. By booking a facility demo session, accessing our premises, picking up an E-Shop order, or participating in any authorized training activities, you confirm that you have read, understood, and agreed to the following Terms. If you do not agree, please do not use the facility. In the event of any discrepancy, inconsistency, or conflict between the Chinese and English versions, the English version shall prevail.

1. 服務條款 / TERMS OF SERVICE

1.1 一般條款 / General

「Picky Picky Pickleball」、「我們」或「本公司」均指於香港註冊成立之 Picky Picky Limited。本條款適用於所有預約會員、測試顧客、商務賓客、受邀人士及合作球隊參與者。本公司保留全權酌情拒絕任何未經預約人士進場、暫停其體驗權限或終止其參與資格之權利。 “Picky Picky Pickleball”, “we”, “us” or “our” refers to Picky Picky Limited, incorporated in Hong Kong. These Terms apply to all registered members, demo customers, business guests, invitees, and affiliated team participants. We reserve the right to refuse entry to unappointed individuals, suspend access, or terminate participation at our sole discretion.

1.2 專屬預約與智能門禁 / Private Appointment & Smart Access

您確認並同意：本場所作為品牌總部及專屬展示體驗中心，實施嚴格預約制及智能門禁管理，不設現場即場門市售票或未預約公眾散客入場。本場所在特定時間可能沒有現場工作人員。您完全自行承擔進入及體驗設施之一切風險。 您有責任：安全進出場館；於進出時妥善關好門戶；防止未經授權人士進入；確保您的隨行賓客遵守所有條款。門禁憑證（包括電子通行證、QR Code 進出碼、智能進場連結）僅供已預約人士使用，不得私自傳閱。嚴禁尾隨進入、替未預約人士開門或容許非授權人士進場。任何濫用情況均可能導致體驗權限被即時終止而不獲退款，並須就因此引致的損失（包括場地及裝備損壞）承擔法律與經濟責任。

You acknowledge and agree that: As a brand headquarters and private showroom, the facility operates on a strict reservation-only and smart door-access system. It is NOT open to the general walk-in public. Staff may not be present on-site at all times. You enter and experience the facility entirely at your own risk. You are responsible for: Safe entry and exit; Securing doors upon entry and exit; Preventing unauthorized access; Ensuring your guests comply with all Terms. Access credentials (QR codes, digital passes, smart entry links) are strictly for reserved users and must not be shared. Tailgating, holding doors open, or granting entry to unappointed individuals is strictly prohibited. Any misuse may result in immediate revocation of access without refund, and full liability for any resulting losses or property damage.

1.3 預訂人及隨行人員責任 / Booking Holder & Guest Responsibility

作出設施體驗或試打預約之人士（「預訂人」）確認其須對其預訂下出席的所有隨行人員（包括賓客）負責，並確保所有隨行人員已閱讀並同意本條款及責任豁免書。預訂人須就其隨行人員引起之任何申索向本公司作出彌償。 未成年人條款：任何未滿 16 歲之人士必須由成年人（滿 18 歲或以上）全程陪同方可進入及使用設施。若預訂人之隨行人員包含未成年人，預訂人即視為該未成年人之法定監護人或已取得其監護人之合法授權，並同意為該未成年人之安全及行為承擔全部法律責任。 每個體驗專區每次預約設有最高容許人數。如超出上限，本公司有權拒絕超額人士進場、收取額外附加費或即時終止該體驗時段且不予退款。

The person making the booking (“Booking Holder”) agrees that they are responsible for all individuals attending under their reservation and must ensure all guests have read and agreed to these Terms and Waiver. The Booking Holder shall indemnify the Company against any claims arising from their guests. Minor Clause: Any person under the age of 16 must be accompanied by an adult (aged 18 or above) at all times within the facility. If the Booking Holder’s guests include minors, the Booking Holder is deemed to be the legal guardian or to have obtained legal authorization from the minor's guardian, and agrees to accept full legal responsibility for the minor's safety and conduct. Each testing zone has a maximum permitted capacity per booking. Exceeding capacity may result in refusal of entry for additional players, additional charges, or immediate termination of the session without refund.

1.4 預約及付款 / Bookings & Payments

所有設施體驗、發球機測試及試打預約必須透過本公司官方網站或指定網上系統進行。預約僅於成功付款並收到 confirmation 訊息及門禁 QR Code 後方為成立。付款方式包括：轉數快 (FPS)、PayMe、微信支付 (WeChat Pay) 及 支付寶 (Alipay)。本公司不對任何技術錯誤、網絡中斷、門禁系統故障或第三方支付平台處理延誤承擔責任。 使用者不得於其預約時段開始前 5 分鐘以上進入體驗區。如使用者於原定預約結束時間後仍繼續佔用設施超過 10 分鐘，本公司保留向預訂人額外收取一小時費用之權利。

All facility experience and demo bookings must be made via our designated online system. Bookings are confirmed only upon successful payment and issuance of an official confirmation message with access QR Code. Payment methods include: FPS, PayMe, WeChat Pay, and Alipay. We are not liable for technical errors, internet disruptions, access system failures, or third-party payment processing delays. Users must not enter the testing zone more than 5 minutes before their scheduled booking time. If users continue to occupy the facility for more than 10 minutes beyond the scheduled end time, the Company reserves the right to charge the Booking Holder for an additional full hour.

1.5 授權用途與設施指引 / Authorized Use & Facility Guidelines

本場所專用於 Picky Picky 品牌展示、線上商城（E-Shop）訂單自提、多品牌球拍與裝備試打、智能發球機測試、Division B / C 品牌代表隊訓練及 DUPR 技術評核。未經本公司事先書面同意，嚴禁擅自進行非授權之商業售票活動、未經批准之公開展覽或未授權之商業拍攝。違反本條款將導致即時終止體驗時段且不予退款，本公司並保留追討相關損失之權利。

This facility is strictly dedicated to Picky Picky brand displays, E-Shop order self-pickups, multi-brand paddle demos, smart ball machine testing, Division B/C team training, and DUPR technical assessments. Unauthorized ticketed events, unapproved public exhibitions, or commercial filming without prior written consent are strictly prohibited. Violation will result in immediate termination of the session without refund, and the Company reserves the right to recover any resulting losses.

1.6 行為守則與場地損壞 / Code of Conduct & Property Damage

嚴禁以下行為：騷擾、暴力、吸煙、電子煙、飲酒、非法藥物及任何危險行為。 使用 APBA 認證地墊體驗區時，必須穿著不脫色專業運動鞋（Non-marking court shoes）。若參加者穿著不符合規定之鞋履進入、損壞地墊設施或以任何不當方式使用現場試用裝備，本公司保留收取清潔費、場地及裝備修復費及／或即時終止其體驗且不予退款之權利。

The following are strictly prohibited: harassment, violence, smoking, vaping, alcohol consumption, illegal substances, and any unsafe conduct. Non-marking court shoes must be worn at all times on the APBA-certified court surface. If a participant enters wearing non-compliant footwear, damages the turf, or misuses demo equipment, the Company reserves the right to charge a cleaning fee, property/equipment restoration fee, and/or immediately terminate the session without refund.

1.7 傷害及事故通報 / Injury & Incident Reporting

於場館內發生之任何受傷、意外或設備不安全情況，必須於 24 小時內以書面方式（Email 或 WhatsApp）通知本公司，以助本公司作出適當調查與跟進。

Any injury, accident, or unsafe equipment condition occurring on the premises must be reported to us in writing (via Email or WhatsApp) within 24 hours to assist the Company in conducting a proper investigation.

1.8 閉路電視與安全監控 / CCTV & Security Surveillance

為維護品牌總部安全、裝備資產保護及門禁管理，場內設有 24 小時閉路電視（CCTV）系統。進入本場所即表示您同意接受安全錄影。 同時，如本公司在進行官方裝備測試、品牌活動或球隊訓練時進行拍攝，在取得閣下同意後，相關影像可能用於官方社交媒體或推廣用途。

CCTV is in 24-hour operation for facility security, asset protection, and access control. By entering the premises, you consent to security recording. Additionally, when the Company conducts official gear testing or team training broadcasts, with your consent, footage may be used for official social media or promotional purposes.

1.9 責任限制 / Limitation of Liability

根據香港法律《管制免責條款條例》（第71章）之規定，本公司並不排除因本公司疏忽而引致的人身傷亡責任。 在上述法律允許的最大範圍內：Picky Picky Limited、其董事、員工及承辦商，均毋須就因使用者自願參與裝備測試與體驗活動、自身健康狀況、不當使用設施或不可抗力事件而引起之任何受傷、財物損失、損害、意外或死亡承擔責任。在任何情況下，本公司之責任總額（如有）不得超過相關預訂所實際支付之金額。

In accordance with the Control of Exemption Clauses Ordinance (Cap. 71) of Hong Kong, the Company does not exclude liability for death or personal injury caused by the Company's negligence. To the fullest extent permitted by law: Picky Picky Limited, its directors, employees, and contractors shall not be liable for any injury, property loss, damage, accident, or death arising from voluntary participation in testing activities, user's health condition, misuse of facilities, or force majeure events. In any event, our total liability (if any) shall not exceed the amount actually paid for the relevant booking.

1.10 適用法律 / Governing Law

本條款受香港特別行政區法律管轄，並受香港法院專屬司法管轄權管轄。 These Terms are governed by the laws of the Hong Kong Special Administrative Region and subject to the exclusive jurisdiction of the courts of Hong Kong.

2. 取消及惡劣天氣政策 / CANCELLATION & SEVERE WEATHER POLICY

2.1 取消政策 / Cancellation Policy

所有體驗預約一經確認，概屬最終決定。取消預訂、缺席或遲到恕不退款。所有時段均按預定時間結束。 All bookings are final. No refunds will be issued for cancellations, no-shows, or late arrivals. Sessions will end strictly at their scheduled times.

2.2 惡劣天氣政策 / Severe Weather Policy

若天文台於您的預約時段開始前 2 小時內，已發出或仍然發出 八號或以上颱風信號 或 黑色暴雨警告，本體驗中心將會關閉。本公司將安排全額改期或發放同等價值的預約額度（Credit）。除本公司全權酌情決定外，恕不提供現金退款。 若上述警告信號於您的預約時段開始前 2 小時或更早時間除下，場館將照常開放，該體驗時段將按原定安排進行，不設改期或退款。

If a Typhoon Signal No. 8 or above or Black Rainstorm Warning is hoisted or remains in force within 2 hours before your scheduled booking time, the facility will be closed. The Company will arrange a reschedule or offer booking credit of equivalent value. No cash refunds will be provided unless determined at our sole discretion. If the warnings are lowered 2 hours or more before your booking time, the facility will open and the session must proceed as scheduled; no rescheduling or refund will be granted.

3. 私隱政策與資料保護 / PRIVACY POLICY

Picky Picky Limited 嚴格遵守香港《個人資料（私隱）條例》（第486章）。 Picky Picky Limited strictly complies with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.

3.1 資料收集與使用 / Data Collection & Use

我們收集的個人資料（包括姓名、電話號碼、電郵地址、E-Shop 自提紀錄及體驗預約紀錄）僅用於處理設施預約、發送門禁 QR Code、提供客戶服務、安全監控以及履行法律責任。提供個人資料屬自願性質，但為處理預約與門禁所必需。我們絕不向第三方出售您的個人資料。

Personal data collected (including name, phone number, email address, order pickup records, and booking history) is used solely for processing reservations, sending door-access QR codes, customer service, security, and legal compliance. Providing data is voluntary but necessary for access. We will never sell your personal data to third parties.

3.2 查閱及更正資料權利 / Your Rights

4. 責任豁免及風險承擔 / WAIVER OF LIABILITY & ASSUMPTION OF RISK

4.1 風險承擔 / Assumption of Risk

參與匹克球體驗及測試活動涉及固有風險（包括但不限於拉傷、碰撞、受傷、或因自身身體狀況引致的突發疾病）。您確認乃自願參與，並明白本場所實施智能門禁及預約體驗模式，您自願承擔與使用本場所設施及測試裝備相關之一切固有風險。

Participation in pickleball demo and testing activities involves inherent risks (including sprains, collisions, injuries, or sudden illness due to personal medical conditions). You acknowledge that your participation is entirely voluntary, and you understand that the facility operates on a smart-access reservation basis. You voluntarily assume all inherent risks associated with using the premises and demo equipment.

4.2 預訂人對隨行人員之擔保 / Acknowledgment of Guest Risk

預訂人確認並保證其所有隨行人員（包括未成年人）均屬自願參與並承擔上述風險。如因任何隨行人員未能個別簽署或閱讀本條款而引起任何爭議，預訂人同意承擔一切相關法律與賠償責任。

The Booking Holder confirms and warrants that all their guests (including minors) participate voluntarily and assume the aforementioned risks. The Booking Holder agrees to accept full legal and financial liability for any claims arising from guests who have not individually read these Terms.

4.3 法律確認 / Acknowledgment

凡預約設施體驗、辦理 E-Shop 取貨或進入本場所，即表示您已清楚閱讀、完全明白並同意接受本條款、取消政策、私隱政策及責任豁免書之所有內容。

By booking a session, picking up an order, or entering the premises, you confirm that you have read, fully understood, and agreed to be bound by all the provisions of these Terms of Service, Cancellation Policy, Privacy Policy, and Waiver.
